Max is arguing most basically that Bigger's action represents at least partially an outcome of the vicious racist attitude that is so prevalent throughout the story. Instead of a simple pleading of insanity, Max tries to elucidate this "elephant in the room"--namely, the racism of the incredible white mob.

While this argument is tremendously courageous, it is not necessarily effective. The judge simply dismisses this argument as "communism."
