The Tenth Amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." This doctrine is developed at length in the Federalist Papers--where it is clear that the federal government has the burden of proof in regards to its legitimacy of power.
